BackgroundIn specific situations it may be necessary to make an exception to the general rule of informed consent for scientific research with an intervention. Earlier reviews only described subsets of arguments for exceptions to waive consent.MethodsHere, we provide a more extensive literature review of possible exceptions to the rule of informed consent and the accompanying arguments based on literature from 1997 onwards, using both Pubmed and PsycINFO in our search strategy.ResultsWe identified three main categories of arguments for the acceptability of (...) a consent waiver: data validity and quality, major practical problems, and distress or confusion of participants. Approval by a medical ethical review board always needs to be obtained. Further, we provide examples of specific conditions under which consent waiving might be allowed, such as additional privacy protection measures.ConclusionsThe reasons legitimized by the authors of the papers in this overview can be used by researchers to form their own opinion about requesting an exception to the rule of informed consent for their own study. Importantly, rules and guidelines applicable in their country, institute and research field should be followed. Moreover, researchers should also take the conditions under which they feel an exception is legitimized under consideration. After discussions with relevant stakeholders, a formal request should be sent to an IRB. (shrink)

Current analytical philosophies of romantic love tend to identify the essence of such love with one specific element, such as concern for the beloved person, valuing the beloved person or the union between the lovers. This paper will deal with different forms of the union theory of love which takes love to be the physical, psychic or ontological union of two persons. Prima facie, this theory might appear to be implausible because it has several contra-intuitive implications, and yet, I submit, (...) it is more coherent and attractive than it seems to be. I shall distinguish three specific models and thereby offer a differentiated account of the union theory which has not previously been provided in the literature. I will claim that two of these models should be rejected. I shall then defend the third model against certain possible objections ; but nevertheless, I shall conclude by showing how this model, too, faces further significant objections which ultimately expose the limits of the union theory of love. In conclusion, I will sketch the outlines of a non-reductive cluster theory of love. (shrink)

This paper deals primarily with theDoctrine of Method(DM) of Kant’sDoctrine of Virtue. First, I present an overview of theDM(1.1) and an explanation of how it is possible to teach virtue (1.2). Second, I address the following issues: Why is aDMnecessary at all (2.1)? How does theDMrelate to what Kant calls casuistry (2.2)? I will argue that wide duties have two essential characteristics: They command the right kind of moral motivation in terms of a moral maxim, and they allow for latitude. (...) Polyamorie ist romantische Liebe, die sich auf mindestens zwei Personen bezieht oder beziehen kann. Eine solche Definition klingt leichter als sie es tatsächlich ist. Um eine genaue und adäquate Analyse von Polyamorie zu leisten, muss, erstens, geklärt werden, was Liebe – die hier allein als romantische Liebe thematisiert wird – überhaupt ist. Sie ist, so soll gezeigt werden, ein spezifisches dispositionales Emotionsmuster, das eine besonders starke Form der subjektiven Bedeutsamkeit konstituiert. Auf dem Hintergrund dieses Verständnisses von romantischer Liebe im Allgemeinen (...) soll dann, zweitens, gezeigt werden, dass polyamore Liebe keine andere Form der Liebe ist als monoamore Liebe, sondern sich als romantische Liebe allein durch die divergierende Anzahl der Personen, die Gegenstand der Liebe sind, von monoamorer Liebe unterscheidet; besonderer Auszeichnungen wie verantwortlich oder konsensuell, wie sie in der Literatur geläufig sind, bedarf eine so verstandene polyamore Liebe, um sie hinreichend zu definieren, also nicht. Beachtet man aber, dass es eine Sache ist, polyamore Liebe, verstanden als emotionales Phänomen, zu definieren, und eine durchaus ganz andere Sache, polyamore Beziehungen zu definieren, bleibt Raum für die Frage, wann genau eine Beziehungskonstellation eigentlich polyamor ist, oder wann eine polyamore Person einfach nur mehrere Personen liebt, ohne dass die entstehende Beziehungskonstellation als solche aber polyamor wäre. Schließlich soll, drittens, das Verhältnis von Polyamorie und Sexualität beleuchtet werden. Auch wenn Sexualität für gewöhnlich als eines der hervorstechenden Elemente der romantischen Liebe verstanden wird, gehört sie gar nicht notwendig zu ihr – und jedenfalls hätte die Behauptung, dass eine notwendige Beziehung zwischen Polyamorie und gelebter Sexualität besteht, begrifflich-normative Konsequenzen, die man wohl gar nicht haben will. Es wird gezeigt, warum es keine notwendige Beziehung zwischen Liebe und Sexualität gibt – weder zwischen monoamorer noch zwischen polyamorer Liebe und Sexualität. The debate between moral realism and antirealism plays an important role in contemporary metaethics as well as in the interpretation of Kant’s moral philosophy. This volume aims to clarify whether, and in what sense, Kant is a moral realist, an antirealist, or something in-between. Based on an explication of the key metaethical terms, internationally recognized Kant scholars discuss the question of how Kant’s moral philosophy should be understood in this regard. All camps in the metaethical field have their inhabitants: Some (...) contributors read Kant’s philosophy in terms of a more or less robust moral realism, objectivism, or idealism, and some of them take it to be a version of constructivism, constitutionism, or brute antirealism. In any case, all authors introduce and defend their terminology in a clear manner and argue thoughtfully and refreshingly for their positions. The present study examined the effects of thought suppression on sleep-onset mentation. It was hypothesized that the decrease of attentional control in the transition to sleep would lead to a rebound of a suppressed thought in hypnagogic mentation. Twenty-four young adults spent two consecutive nights in a sleep laboratory. Half of the participants were instructed to suppress a target thought, whereas the other half freely thought of anything at all. To assess target thought frequency, three different measures were used in (...) the wake state and mentation reports were repeatedly prompted by a computer at sleep onset. In support of the hypothesis, results revealed a reversal of target thought frequency at sleep onset: Participants instructed to suppress reported fewer target thoughts than did controls before falling asleep, but more target thoughts afterwards. This paper first explores a number of themes in the psychological system developed by the Austrian-American psychologist, Egon Brunswik, focusing on those that had a formative influence on Social Judgement Theory. We show that while perception was a recurring ground for Brunswik's empirical and theoretical work, his psychology was a psychology of cognition in the broadest sense. Next, two major themes in Social Judgement Theory functionalism and probabilism are described, and the elegant formulation known as Brunswik's Lens Model is introduced. (...) Some methodological and theoretical implications of these themes are presented. ContentTruth-telling is an integral part of medical practice in many parts of the world. However, recent public inquiries, including the Francis Inquiry reveal that a duty of candour in practise, are at times compromised. Consequently, the duty of candour became a statutory requirement in England. This study aimed to explore clinicians’ perspectives of the implications of the legislation for medical ethics education, as raising standards to improve patient safety remains an international concern.MethodsOne-to-one interviews with clinical educators from various specialties who (...) contribute to the MBChB programme at the authors’ university. Once data saturation had been assessed, transcripts were analysed using a thematic approach by the following concurrent activities: data reduction and coding into themes. Recent studies have shown the importance of integrating multisensory information in the body representation for constituting self-consciousness. However, one idea that has received only scant attention is that our body representation is also constituted by knowledge of bodily visual characteristics . Here in two experiments we used a full body crossmodal congruency task in which visual distractors were presented on a photograph of the participant, another person, who was either familiar or unfamiliar, or an object. Results revealed that during the (...) ‘self-condition’ CCEs were enhanced compared to the ‘other condition’. The CCE was similar for unfamiliar and familiar others. CCEs for the object condition were significantly smaller. The results show that presentation of an irrelevant image of a body affects multimodal processing and that the effect is enhanced when that image is of the self. The results hold intriguing implications for body representation in social situations. (shrink)

Withholding or withdrawing life-saving ventilators can become necessary when resources are insufficient. In the USA, such rationing has unique social justice dimensions. Structural elements of dominant allocation frameworks simultaneously advantage white communities, and disadvantage Black communities—who already experience a disproportionate burden of COVID-19-related job losses, hospitalisations and mortality. Using the example of New Jersey’s Crisis Standard of Care policy, we describe how dominant rationing guidance compounds for many Black patients prior unfair structural disadvantage, chiefly due to the way creatinine and (...) life expectancy are typically considered.We outline six possible policy options towards a more just approach: improving diversity in decision processes, adjusting creatinine scores, replacing creatinine, dropping creatinine, finding alternative measures, adding equity weights and rejecting the dominant model altogether. We also contrast these options with making no changes, which is not a neutral default, but in separate need of justification, despite a prominent claim that it is simply based on ‘objective medical knowledge’. In the regrettable absence of fair federal guidance, hospital and state-level policymakers should reflect on which of these, or further options, seem feasible and justifiable.Irrespective of which approach is taken, all guidance should be supplemented with a monitoring and reporting requirement on possible disparate impacts. The hope that we will be able to continue to avoid rationing ventilators must not stand in the way of revising guidance in a way that better promotes health equity and racial justice, both to be prepared, and given the significant expressive value of ventilator guidance. Workplace bullying is a phenomenon that can have serious detrimental effects on health, work-related attitudes, and the behavior of the target. Particularly, workplace bullying exposure has been linked to lower level of general well-being, job satisfaction, vigor, and performance and higher level of burnout, workplace deviance, and turnover intentions. However, the psychological mechanisms behind these relations are still not well-understood. Drawing on psychological contract and self-determination theory (SDT), we hypothesized that perceptions of contract violation and the frustration of basic needs (...) mediate the relationship between workplace bullying exposure and well-being, attitudinal, and behavioral outcomes. Self-reported data were collected among employees with different working backgrounds (N= 1,257)viaAmazon's Mechanical Turk in an online survey. Results showed that feelings of contract violation and frustration of basic needs accounted for unique variation in well-being, work satisfaction, burnout, vigor, and turnover intentions, pointing to individual contributions of both psychological mechanisms. However, when controlled for frustration of basic needs, feelings of psychological contract violation were no longer a mediator between workplace bullying exposure and work performance. Helping employees to deal effectively with workplace bullying exposure might buffer its negative effects and reduce their experienced frustration of basic needs, preserving their well-being, vigor, and work performance and, eventually, prevent burnout. The present study is the first to concurrently elucidate the proposed psychological mechanisms and unique contributions of psychological contract violation and frustration of basic needs in the context of workplace bullying. Action semantics enables us to plan actions with objects and to predict others' object-directed actions as well. Previous studies have suggested that action semantics are represented in a fronto-parietal action network that has also been implicated to play a role in action observation. In the present fMRI study it was investigated how activity within this network changes as a function of the predictability of an action involving multiple objects and requiring the use of action semantics. Participants performed an action prediction (...) task in which they were required to anticipate the use of a centrally presented object that could be moved to an associated target object (e.g., hammer—nail). The availability of actor information (i.e., presenting a hand grasping the central object) and the number of possible target objects (i.e., 0, 1, or 2 target objects) were independently manipulated, resulting in different levels of predictability. It was found that making an action prediction based on actor information resulted in an increased activation in the extrastriate body area (EBA) and the fronto-parietal action observation network (AON). Predicting actions involving a target object resulted in increased activation in the bilateral IPL and frontal motor areas. Within the AON, activity in the left inferior parietal lobe (IPL) and the left premotor cortex (PMC) increased as a function of the level of action predictability. Together these findings suggest that the left IPL represents stored hand-postures that can be used for planning object-directed actions and for predicting other's actions as well. (shrink)

We respond to recent comments on our proposal to improve justice in ventilator triage, in which we used as an example New Jersey’s publicly available and legally binding Directive Number 2020-03. We agree with Bernard Lo and Doug White that equity implications of triage frameworks should be continually reassessed, which is why we offered six concrete options for improvement, and called for monitoring the consequences of adopted triage models. We disagree with their assessment that we mis-characterised their Model Guidance, as (...) included in the NJ Directive, in ways that undermine our conclusions. They suggest we erroneously described their model as a two-criterion allocation framework; that recognising other operant criterion reveals it ‘likely mitigate[s] rather than exacerbate[s] racial disparities during triage’, and allege that concerns about inequitable outcomes are ‘without evidence’. We highlight two major studies robustly demonstrating why concerns about disparate outcomes are justified. We also show that White and Lo seek to retrospectively—and counterfactually—correct the version of the Model Guideline included in the NJ Directive. However, as our facsimile reproductions show, neither the alleged four-criteria form, nor other key changes, such as dropping the Sequential Organ Failure Assessment score, are found in the Directive. These points matter because our conclusions hence stand, because the public version of the Model Guidance had not been updated to reduce the risk of inequitable outcomes until June 2021 and NJ’s Directive still does not reflect these revisions, and, hence, represents a less equitable version, as acknowledged by its authors. We comment on broader policy implications and call for ways of ensuring accurate, transparent and timely updates for users of high-stakes guidelines. (shrink)

Three decades ago Gilbert posited that novel proteins arise by re‐shuffling genomic sequences encoding polypeptide domains. Today, with numerous genomes and countless genes sequenced, it is well established that recombination of sequences encoding polypeptide domains plays a major role in protein evolution. There is, however, less evidence to suggest how the novel polypeptide domains, themselves, arise. Recent comparisons of genomes from closely related species have revealed numerous species‐specific exons, supporting models of domain origin based on “exonization” of intron sequences. Also, (...) a mechanism for the origin of novel polypeptide domains has been proposed based on analyses of insertion‐based polymorphisms between orthologous genes across broad phylogenetic spectra and between allelic variants of genes within species.
